CoWS Service Conditions

ALL SHIPMENTS TRANSPORTED BY SCHRADER TRUCKING COMPANY WILL BE SUBJECT TO THE STANDARD TRUCKLOAD BILL OF LADING CONTRACT TERMS AND CONDITIONS ( STBOL). A COPY OF WHICH IS CONTAINED IN PDF FILE FORMAT ON THIS WEBSITE. SCHRADER DRIVERS WILL SIGN NONCONFORMING BILLS AS RECEIPT FOR GOODS ONLY BUT ALL SHIPMENTS TRANSPORTED UNDER NONCONFORMING BILLS OF LADING ARE SUBJECT TO THE STBOL AND TERMS AND CONDITIONS THEREOF.

1. Brokers shall not have the right to offset damage claims from revenue due Schrader Trucking Company as a broker who merely arranges for transportation does not have liability for cargo loss or damage.
   
2. SCHRADER TRUCKING COMPANY will not “indemnify and hold harmless”the shipper or broker from acts or negligence Schrader Trucking Company has no control over. Instead Carrier and Shipper or Broker will each indemnify, defend, and hold the other harmless from and against any liability, losses, damages, claims, judgments, fines ,penalties, lawsuits, and expenses ( Costs ) resulting from personal injury, property damage ( other than cargo) or violation of the law caused by their respective negligent or wanton acts or omissions.
   
3. Cargo claim provisions shall be in accordance with the Carmack Amendment (49 U.S.C. 14706 subject to your agreed released evaluation maximum. Schrader Trucking Company is not responsible for any “special, “consequential” or “liquidated” damages.
   
4. Schrader trucking company will not give up its nonrecourse provisions to any broker who fails to pay the agreed rate for transportation of a shipment. Schrader will maintain recourse to collect from either the consignor or consignee in the event of non-payment by the Broker.
